Commercial Truck Accident FAQs: What All Drivers Should Know

Most of us know that accidents are all too common and are often preventable. But not every crash will end in devastation: the result of a car collision can range from minor fender-benders to major damages. However, accidents with commercial trucks are almost always going to result in at least some kind of substantial injury. Not only are trucking accidents typically more serious than the average car crash, but they can also be much more complex when it comes to filing a claim. That's why you need a Dallas truck wreck attorney by your side. Before you're ever involved in a tractor trailer crash, here are a few things you need to know.

Why are accidents with commercial trucks usually more serious than regular vehicle collisions?

The average passenger car weighs approximately 3,000 pounds, but a fully-loaded commercial truck can weigh upwards of 80,000 pounds. That massive difference translates to significantly more damage when vehicles collide. It's much more likely that you'll become injured in a trucking accident than in a passenger vehicle accident, and it's also more likely that your injuries could be fatal. A truck could easily crush your vehicle and its occupants with one wrong move on the road.

What are some common factors that come into play with commercial truck accidents?

While distracted driving accounted for 10% of all car crash fatalities in 2014, these behaviors aren't usually a common cause of trucking accidents (although it has been known to happen, especially when the driver of a car collides with a truck due to negligence on their part). More often than not, trucking accidents can be attributed to certain properties of the truck itself - such as longer breaking time and reduced visibility - and a failure of a passenger driver to recognize these attributes properly. It takes a much longer time for a truck driver to respond to road hazards. If a passenger car driver makes a quick and reckless move, it can be extremely difficult for a truck driver to respond in time and preserve the safety of everyone involved.

How are claims for accidents with commercial trucks different from those involving other vehicles?

The owners and drivers of commercial trucks are subject to much stricter regulations than those who own more conventional vehicles. Licensed commercial truck drivers have to follow the Federal Motor Carrier Safety Regulations to increase accountability and prevent fatigue. And commercial truck companies have to carry at least $750,000 in insurance coverage (or at least $5 million if the trailer contains hazardous materials!). Both the driver and trucking company may be held liable for an accident if the driver is clearly employed (i.e., not an independently contracted driver) by the company and if the circumstances of a specific case call for it.

What should I do if I'm involved in a trucking accident?

Immediately following accidents with commercial trucks, your safety and health should be your top priority. Be sure to seek out medical treatment and call the police right away. You should also collect contact information for people involved or witnesses to the accident and document the event in words and photos, if possible, as best you can. Then, seek out an experienced truck accident attorney. These cases can be extremely complicated, so it's best to have someone knowledgeable and reputable to help you.

If you or someone you love has been involved in a commercial truck accident, you need a lawyer who specializes in these kinds of claims. For more information or to schedule a consultation, contact Parks Law Firm today.
