Slip and Fall Cases: 3 Ways To Prove Liability

  • If either the owner of the business or an employee caused the source of the slip or unstable surface, and you have evidence of this, they can be found liable for your injuries. This might apply to spilled oil, a hole in the sidewalk, or a missing step that they removed.
  • A business owner who knew that the unsafe surface existed, and did nothing to fix it, can be found liable for any personal injury cases involving a fall accident. That said, it's difficult to prove they knew the problem existed in the first place.
  • If any reasonable person could recognize the source of the slip and fall case, then the owner should have known it was there, dangerous, and should have fixed it. This is the most common approach to slip and fall cases because it hinges on the whether it would be reasonable to believe that the store owner should have known about the risk of someone falling.

    For example, if there was a massive crack in the sidewalk outside of the store where the owner parks their car every day, it would seem fair to assume that they know it's there. On the other hand, if there's a spill in aisle 13 that goes unannounced, and the owner is outside at the time, it's less fair to suggest they should have known.
